Article 1 In order to supervise the implementation of the Mine Safety Regulations by mining enterprises, institutions and their competent authorities, the State implements a mine safety supervision system and sets up mine safety supervision agencies and mine safety inspectors.

Article 2 The State Administration of Labor shall set up the Mine Safety Supervision Bureau, and the labor safety supervision department of the labor bureaus (offices) of the provinces, autonomous regions and municipalities directly under the Central Government shall set up mine safety supervision offices, and the mine safety supervision rooms (groups) shall be set up in the areas where the mines are concentrated.
The mine safety supervision institutions at all levels are led by the labor department at the same level, and the business is guided by the superior mine safety supervision agency.
The appointment, removal and transfer of the main responsible persons of mine safety supervision institutions at all levels shall be reported to the first-level mine safety supervision agency for the record.

Article 3 The mine safety supervision organization shall set up a mine safety inspector, and shall be selected from senior engineers, engineers, assistant engineers and mine (department) level cadres who are familiar with mine safety technical knowledge and can engage in underground inspection work.
The ombudsman of the Mine Safety Supervision Bureau of the State Labor General Administration shall be appointed by the State Labor General Administration; the ombudsman of the local mine safety supervision agency shall be appointed by the labor bureau (office) of the province, autonomous region or municipality directly under the Central Government and reported to the Mine Safety Supervision Bureau of the State Labor General Administration for the record.
The ombudsman is issued by the appointing authority to the Mine Safety Inspector Certificate. The ombudsman's card is uniformly printed by the National Labor Bureau.

Article 4 The main functions of the mine safety supervision agency are:
1. To publicize the safety production policy and labor protection policies and decrees, and supervise the implementation of the Mine Safety Regulations;
2. Supervise mining enterprises to carry out safety education and technical training;
3. Participate in the mine design review and the completion and acceptance of the mine project, and participate in the identification of mine safety scientific research results and related new technologies;
Fourth, check the completion of the mine safety enterprise technical measures and the use of funds for safety technical measures;
5. Inspecting mine safety work, and submitting opinions on violations of the Mine Safety Regulations and the safety and health of employees, and if necessary, may issue a Notice of Mine Safety Supervision Opinion to the relevant mining enterprises, institutions or their competent authorities. Require them to correct within a time limit or to resolve within a time limit;
6. Participate in the investigation of mine accidents and supervise the handling of accidents;
7. Mine enterprises and related staff members who commit serious violations of the Mine Safety Regulations are entitled to fines;
8. The responsibilities and leaders of mining enterprises and their competent departments that seriously violate the Mine Safety Regulations have the right to submit administrative sanctions to the leading organs at higher levels, or to the judicial organs to punish them according to law;
9. For mining enterprises that do not have the basic conditions for safety, they have the right to request the relevant departments to suspend production for rectification or closure.

Article 5 The mine safety inspector shall, with his or her certificate, have the right to enter the on-site inspection at any time within the scope of his/her responsibility, and have the right to participate in relevant meetings held by the mining enterprise, to read relevant materials, and to obtain information from relevant units or personnel.
When the mine safety inspector conducts on-site inspections, it is found that there are situations that endanger the safety and health of the employees. They have the right to request immediate correction or to solve the problem within a time limit. In case of emergency, they have the right to request immediate evacuation of the operators from the danger zone.

Article 6 The mine safety inspector finds violation of the Mine Safety Regulations, does not stop it in time, and does not report to the higher authorities. Mine safety inspectors are severely punished if they abuse their powers and engage in malpractices.

Article 7 The mine safety supervision agency shall support the work of the safety agencies, industrial health institutions and mine rescue teams of mining enterprises, and give necessary guidance in business. The safety agencies, industrial health agencies and mine rescue teams of mining enterprises have the right to directly report the safety work of the enterprises to the mine safety supervision agencies or mine safety inspectors, and provide relevant information.

Article 8 The mine safety supervision organization shall cooperate with the departments of health and environmental protection, work in a division of labor, communicate frequently, study problems together, and organize joint inspections when necessary.

Article 10 The mine safety supervision agency and the mine safety inspector shall closely contact the masses, rely on the trade union organization and the mine workers to carry out their work and accept the supervision of the masses.

   Article 11 These Regulations shall come into force on July 1, 1982.
